SellingInnovations, LLC (“we” or “us”) is committed to protecting your personal information.
This Privacy Policy (the "Policy") explains how we collect and use personal information that you provide: via our public website www.jolteffect.com (the "Sites"); or offline when participating in any subscriber Program run by SellingInnovations. The Policy applies to all Sites and services where the Policy is posted.
This Policy also applies to information we collect from you and/or your employer via our survey and assessment tools. Depending on where you are resident, you may be shown a confidentiality notice before participating. Please note that in cases where the terms of any such survey-specific confidentiality notice conflict with any terms in this Policy, the survey-specific terms will take precedence over the terms in this Policy.
We use your data to provide and improve the Sites and our services. By using our Sites, survey and assessment tools, or participating in our subscriber Programs, you agree to the collection and use of your personal information as outlined in this Policy. If you do not agree with the content of this Policy, you should not provide us with any personal information.

The Data Controller is SellingInnovations, LLC of 4552 Wolf Road, Western Springs, Illinois 60558, USA.
Please note that when we perform surveys or collect data at the specific request of your employer, the Data Controller is your employer.
Information We Collect
Information We Collect From You or Your Employer. Information we collect from you or your employer may include your name, business or personal email address, job title, organization, organization’s physical address, and direct telephone number. You may need to provide certain types of information (e.g., email address) to register as a subscriber, submit a question, participate in a survey, or engage in other transactions on our Sites.
Restricted Areas. If you access the Restricted Areas of any of our Sites (via browser or an App), we may collect information about your access to and use of research materials, decision-support tools, and other online and offline resources we offer.
Usage data. We may also collect information on how the Sites and our services are accessed and used (“usage data”). This usage data may include information such as your computer’s Internet Protocol address (e.g. IP address), browser type, browser version, and pages of our Sites that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
Information from other sources. We also may periodically obtain information about you from other sources. The collection of such information will be in accordance with applicable privacy laws. Examples of information we may receive include updated contact information and additional demographic information. Please note that we may have previously collected personal information relating to you at the time you or your organization enrolled in a Program run by SellingInnovations or any of its subsidiaries, as well as in the course of allocating and issuing to you a unique ID and password to access the Restricted Areas of our Sites.
Tracking and Cookies data. We use cookies and similar tracking technologies to collect information about your activities on our Sites.
Cookies. When you visit our Sites, we may assign your computer one or more "cookies." A cookie is a small text file containing information that we can read later to facilitate your access to our Sites and personalize your online experience. Cookies are sent to your browser from a website and stored on your device. Other tracking technologies are also used such as beacons, tags and scripts to collect and track information and improve and analyze our Sites. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Sites.

How We Use The Information We Collect
We use the information we collect about you for the following purposes, including:

  • to respond to your inquiries;
  • to administer your subscribership in any of our Programs and facilitate your access to the Sites and SellingInnovations materials;
  • to attribute content that you make available through the Sites;
  • to communicate with you about surveys, marketing, promotions, executive-oriented events, educational forums, and other exclusive opportunities offered by SellingInnovations and its subsidiaries, partners, and affiliates, including information about other Programs in which you may be interested (for further details, please see the section “Choices About Your Information” below);
  • to customize the content you see;
  • to engage in research and analysis in order to maintain, protect and improve our Programs, products, and services, as well as develop new products and services;
  • to enforce the legal terms that govern your use of the Sites; and
  • to ensure the technical functioning of the Sites.
 
Subscriber Profiles. On some of our Sites, you may be able to create an online profile, which may include information about your job title, employer, and your experience in different areas. This profile enables other subscribers participating in the subscriber program to determine whether your background and expertise might make you a useful contact on a particular issue. You can choose how much, if any, of your profile information is displayed in subscriber listings or when you post discussion messages in the Discussion areas, and whether to make your information searchable by other subscribers in your particular subscriber program. When you create an online profile and choose to (i) display any of your profile information in the subscriber listings or when you post discussion messages; or (ii) make your profile information searchable by other subscribers; you acknowledge and agree that you are making that information about you available to other subscribers who might use that information to contact you via messages sent through the Sites to obtain the benefit of your expertise.
Discussions. In the event that you post personal information in discussion forums or other areas of the Sites allowing users to upload or post content, please note that this information can be viewed by any user with access to those areas.
California Privacy Statement
California residents have certain rights under the California Shine the Light law and the California Consumer Privacy Act (“CCPA”). CCPA Disclosures In general, within the preceding 12 months:
 
  • We have collected the categories of Personal Information listed above.
  • We have collected these categories of Personal Information directly from you, when you use our Services, and from third parties for the purposes described above.
  • We have disclosed the following categories of Personal Information for business purposes: Identifiers and contact information; professional and employment-related information; commercial information; transactional information; and internet and network activity information.
  • We have not sold your Personal Information.
CCPA Privacy Rights As of January 1, 2020, certain California residents are entitled to privacy rights under the CCPA. Clients who wish to exercise these rights should direct their requests to the Member that controls their Personal Information.
  • The right to know. You have the right to request to know (i) the specific pieces of Personal Information we have about you; (ii) the categories of Personal Information we have collected about you in the last 12 months; (iii) the categories of sources from which that Personal Information was collected; (iv) the categories of your Personal Information that we sold or disclosed in the last 12 months; (v) the categories of third parties to whom your Personal Information was sold or disclosed in the last 12 months; and (vi) the purpose for collecting and selling your Personal Information.
  • The right to deletion. You have the right to request that we delete the Personal Information that we have collected or maintain about you. We may deny your request under certain circumstances, such as if we need to comply with our legal obligations or complete a transaction for which your Personal Information was collected. If we deny your request for deletion, we will let you know the reason why.
  • The right to equal service. If you choose to exercise any of these rights, we will not discriminate against you in anyway. If you exercise certain rights, understand that you may be unable to use or access certain features of our Services.
    You may exercise your right to know and your right to deletion twice a year free of charge. To exercise your right to know or your right to deletion, contact us at [email protected]. We will take steps to verify your identity before processing your request to know or request to delete. We will not fulfill your request unless you have provided sufficient information for us to verify you are the individual about whom we collected Personal Information. If you have an Account with us, we will use our existing Account authentication practices to verify your identity. If you do not have an Account with us, we may request additional information about you to verify your identity. We will only use the Personal Information provided in the verification process to verify your identity or authority to make a request and to track and document request responses, unless you initially provided the information for another purpose. You may use an authorized agent to submit a request to know or a request to delete. When we verify your agent’s request, we may verify both your and your agent’s identity and request a signed document from you that authorizes your agent to make the request on your behalf. To protect your Personal Information, we reserve the right to deny a request from an agent that does not submit proof that they have been authorized by you to act on their behalf. Shine the Light Our California customers are also entitled to request and obtain from Tethr once per calendar year information about any of your Personal Information shared with third parties for their own direct marketing purposes, including the categories of information and the names and addresses of those businesses with which we have shared such information.   • Legal Basis for Processing Personal Data under the General Data Protection Regulation (GDPR)
    If you are from the European Economic Area (EEA), the SellingInnovations legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it. SellingInnovations may process your Personal Data because:
  • We need to perform a contract with you
  • You have given us permission to do so
  • The processing is in our legitimate interests and it is not overridden by your rights
  • To comply with the law
Disclosure of Information
Utilization information. We may share information with our organizational subscribers about how their employees use the Sites and the resources available to them through the Sites (e.g. how employees used certain features of the Sites, utilization trends, which features were most popular with the subscriber’s employees.)
We may share your information with third-party companies or individuals in the following instances:
 
  • When we engage service providers and third-party agents to process personal information on our behalf. When we do so, we contractually require these service providers to implement adequate security and privacy measures to ensure that your personal information will be appropriately protected and only used for the purposes of performing the services for us.
  • In response to subpoenas, court orders, or other legal processes (including for national security and law enforcement purposes); to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases we reserve the right to raise or waive any legal objection or right available to us.
  • When we believe it is appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities; to protect and defend the justified rights, property, or safety of SellingInnovations or its subsidiaries, our customers, or others; and in connection with our Terms of Service and other agreements.
  • In connection with a corporate transaction, such as a divestiture, merger, consolidation, or asset sale, including any pre-transaction diligence, or in the unlikely event of bankruptcy.
We also may share aggregate or anonymous information with third parties, including advertisers, investors, and partners. Aggregate or anonymous information does not contain any personal information and its use and disclosure is not subject to the terms of this Policy.
Our Policy on “Do Not Track” Signals under the California Protection Act (CalOPPA)
We do not support Do Not Track (“DNT”). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.
Your Data Protection Rights under the General Data Protection Regulation (GDPR)
If you are a resident of the European Economic Area (EEA), you have certain data protection rights. SellingInnovations aims to take reasonable steps to allow you to correct, amend, delete or limit the use of your Personal Data. If you wish to be informed about what Personal Data we hold about you and if you want it to be removed from our systems, please contact us. In certain circumstances, you have the following data protection rights:
 
  • The right to access, update or delete the information we have on you. Whenever made possible, you can access, update or request deletion of your Personal Data directly within your account settings section. If you are unable to perform these actions yourself, please contact us to assist you.
  • The right of rectification. You have the right to have your information rectified if that information is inaccurate or incomplete.
  • The right to object. You have the right to object to our processing of your Personal Data.
  • The right of restriction. You have the right to request that we restrict the processing of your personal information.
  • The right to data portability. You have the right to be provided with a copy of the information we have on you in a structured, machine-readable and commonly used format.
  • The right to withdraw consent. You also have the right to withdraw your consent at any time where SellingInnovations relied on your consent to process your personal information. Please note that we will ask you to verify your identity before responding to such requests.
    You have the right to complain to a Data Protection Authority about our collection and use of your Personal Data. For more information, please contact your local data protection authority in the European Economic Area (EEA).
Information Security
We have implemented reasonable technical and organizational security measures to help protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of information. Unfortunately, no data transmission over the Internet can be guaranteed to be entirely secure, and we cannot and do not guarantee or warrant the security of any information that you transmit on or through our Sites or the SellingInnovations App or that we otherwise maintain.
We make reasonable efforts to restrict access to personal information to only those employees, contractors, and agents who need to know that information in order to operate, develop, or improve our Programs, products, and services. We subject our third-party agents to contractual controls to ensure that they appropriately protect and use any personal information they access or receive from us.
Please note that the effective security with respect to our Sites depends, in part, on you ensuring that any IDs and passwords that you have been issued by us are kept confidential and secure and that you adhere to the restrictions on password and ID-sharing set forth in our Terms of Service.
Other Websites
To provide increased value to you, we may provide links to other websites or resources that are not part of the network of Programs, products, or services run by SellingInnovations or its subsidiaries. We do not exercise control over these websites or their privacy practices, and any information you provide to those sites is subject to the Privacy Policies of those sites and not this Policy.

Our Sites contain business-related content and are specifically aimed at and designed for use by adults. We do not knowingly solicit or collect personal information from or about individuals under the age of 18 years.
